Congress, Whistleblower Lawyers Urge SEC to Police ‘De Facto Gag Clauses’

Jordan A. Thomas co-authored a study on de facto gag clauses in August 2014. He is also leading the rulemaking petition to the SEC to conduct public hearings and issue formal rules on employment and severance agreements that address retaliation and gag clauses.

“Congressional interest will hopefully reinforce the SEC’s commitment to protect whistleblowers,” Thomas said.
