Defendant Davian raised at least $1.5 million from investors for investment in several private funds managed by his company Davian Capital. They provided investors with marketing materials containing fictitious returns and profits for the private
funds, and Davian misappropriated most of the money received from investors to pay for personal expenses. He was convicted in a parallel criminal proceeding, reportedly sentenced to 57 months in prison.
